Simple Safety Update – Issue 23 November 2011

Welcome to our November Simple Safety Update. As we head to the harmonisation dead line it pleasing that so many Australia States are committed to meeting the timelines. See our update below on where we are at. Just a quick note to remind you all to take care when hosting workplace functions and to protect yourself from any fallout from over imbibing. Set a start and finish time, provide proper food (not just chips and dips), think about how people will get home and make sure any partying on afterwards is clearly outside the function provided by the company. Most of all have fun!!

OHS News - Director's Duties Confirmed.

A recent case appealed to the NSW Supreme Court has left no doubt that Directors and Company Officers will be held to account for breaches of OHS legislation. Following a fatality the NSW Magistrates Court dismissed the case against the Director of the company, Dekoform, arguing that he was to far removed from the day to day operations to be held responsible.

WorkCover NSW appealed and the Supreme Court found that the Magistrates Court was wrong and that it was wrong to find that the Director was not responsible for putting into place systems which would have identified the unsafe machinery and responded to it.

Did you know?

  • A survey conducted in 2010 by Know the Bull www.know-bull.com found that 52.9% of work place bullies are female.
  • The survey also found that 83.3% of these ‘boss bullies’ (people who initiate the bullying) don’t act alone – preferring to operate as a bully group, or ‘mob’."
  • A one per cent reduction in the number of workplace injuries and diseases will deliver an estimated $85 million saving to the Victorian economy every year, and a saving of $207 million when the cost of pain, suffering and early death is factored in.
